On top of that, if you’re going to break the law, who cares if you humiliate or hurt yourself for a test to prove that you’re breaking the law? If you’re sober and ‘not’ breaking the law then such tests won’t hurt.

I already answered that question. But for the lack of your understanding I will answer it again. A PBT breath test you can refuse. Period. You cannot refuse a chemical testing of blood, urine, or a breathalizer located at the police station which is calibrated properly and requires inspections to the machine. Nowadays blood is the #1 way to determine BAC taken at the hospital or portable labs affiliated with DUI checkpoints. Take it from someone who works in this line of work or not I dont care.

Listen if you blow in the dog gone tester and it shows positive you are drunk. Point blank. This is common sense. Are you you trying to tell me that a person can refuse the breath test and blood test?
Are you trying to state that the only way to prove a person is druknk is by giving the sobriety test?

A simple breath test (PBT) does not proof you were drunk. Its results of the amount you blew is inadmissable in court. Only if there was yes or no alcohol, not how high your BAC was. Your BAC is determined by blood tests generally. PBT’s are used to help support probable cause to take a drunk to the hospital to force blood or other chemical tests. You can refuse a PBT (simple breath test) in PA; however if you refuse the blood test etc… than your license may get suspended for a year.

Lol. So your more worried about her falling over her feet and scraping her knee then taking a 4000 lb. vehicle to a wall or your families car, home, or whatever at 65 mph. Ouch my knee hurts you made me walk a line and im too drunk i fell. Ouch my head hurts. Oops I don’t have one anymore I just totaled my car! Again, its procedure to perform the sobriety tests and for your knowledge she can refuse a PBT.

Irregardlless of what police are required to do a simple breath test can prove that the person is drunk without subjecting them to foolish tests that can cause injury to hurt themselves.

Police are required to perform these tests generally being the 30 second one leg stand, 9 step walk and turn, and the horizontal gaze nystagmus tests. Also departments or individual officers will perform other tests but the state of PA only recognizes the 3 as general procedure. They have the video as proof which is amazing in court. If they did not perform these she could fight the issue of being accused dui without the necessary tests being performed. Job well done. Another moron in custody.
