In some states (for example Connecticut) if you are in a parking lot with 10 or more cars, whether you are mobile or not, you are considered “driving while intoxicated” if you’re drunk in a car in that lot.

they were assholes to him. He said he was drunk, so the refusal of the tests wouldn’t do anything to incriminate him further. He was obviously drunk, but was he driving? doubtful. they are parked in a parking lot. those cops probably saw him in the parked car and decided to exercise some good old police racism on his ass… fuck the police, not the law.
