What is the time frame allowed after a DUI conviction to be expunged from your record/background?

Was charged in N.C. for DUI in 03/2008, am desiring to get this expunged. I do not have any other criminal offense other than this DUI. Therefore, have not previously ever applied for my record to be expunged.

If a court is willing to look at it, it will be 5 to 10 years down the road, not one year.

Unless you worked something out in your plea, criminal activity is NEVER expunged from your record. It is not like it was a traffic violation. If you have already been convicted and didn’t plea yourself into having an exception, you’ll be a DUI convict for life.

I don’t know N.C. law, but the few states in which I’ve dealt with expungements do not allow a DUI to be expunged or sealed.

3 years where I live.
